These conditions of participation are valid for the J.Clay Design Contest 2019, which is organized by J.Clay GmbH & Co. Kg (hereinafter "J.Clay"), Blumenberger Str. 134-145, 41061 Mönchengladbach, Germany.
1. Conditions of participation and realisation of the J.Clay Design Contest 2020
(a) Eligible to participate are persons over 18 years of age who have registered for the J.Clay Design Contest.
(b) The design competition will be held in two stages. First of all there will be a design competition, registration and submission between 25.03.2020 - 13.04.2020, in which all registered participants have the opportunity to submit designs to J.Clay. For this purpose, the participants must provide their designs. The designs must be provided as a PDF file by email to email@example.com.
(c) Ten designs will be selected from all entries by a jury of J.Clay. The selected designs will be published on the J.Clay Facebook page https://www.facebook.com/J.ClaySocks for voting. Winners of the J.Clay Design Contest 2020 are those whose designs received the most votes from visitors to the J.Clay Facebook page (via reaction). The following criteria should be taken into account when the jury makes its selection and visitors to the J.Clay Facebook page vote: Appearance on the product (article), creativity, originality.
(d) The participation in the J.Clay Design Contest 2020 as well as the claiming of the prize is free of charge for the participants.
(e) By participating in the J.Clay Design Contest 2020 each participant agrees to assign the rights of use of the submitted designs in favour of J.Clay.
(a) After the end of the design competition, the winners will be promptly notified of the prize by e-mail via the e-mail address provided in the registration and asked to confirm acceptance of the prize. After confirmation of acceptance of the prize, the prize will be sent as discussed.
(b) If the winner does not confirm acceptance of the prize within a period of 14 days, the prize will be forfeited. If the given contact information is incorrect (e.g. invalid e-mail address), J.Clay is not obliged to research the correct address. The disadvantages resulting from the provision of incorrect contact details are at the expense of the participants.
(c) Profit entitlements are not transferable. The participant may waive the prize. In this case a new winner will be determined.
3. Responsibility and indemnityg
(a) The J. Clay GmbH & Co. KG is not obliged to check the designs provided by the participant for potential violations of the rights of third parties. However, J.Clay is entitled to reject designs if they are illegal or offend common decency in the opinion of J.Clay.
(b) The participant indemnifies J.Clay from all claims of third parties which have arisen due to the contents provided by the participant. You agree to support J. Clay in every reasonable way in the defense of these claims.
4. Early termination
J.Clay has the right to terminate the design competition at any time, even without adherence to deadlines, in whole or in part prematurely or to change its course, if it is not possible to guarantee a proper execution of the design competition for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons.
5. Exclusion from participation
(a) Employees of J.Clay or its affiliates and immediate family and household members of such an employee are not eligible to participate.
(b) J.Clay reserves the right to exclude the participant from the design competition in case of violation of these conditions of participation. This applies in particular if the participant makes false statements or submitted designs violate applicable law or the rights of third parties.
(a) Responsible for the processing of personal data is the J.Clay GmbH & Co. KG, Blumenberger Str. 143-145, 41061 Mönchengladbach. The controller of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.
(b) For the execution and handling of the design competition we process the following personal data of you: user name or nickname. We process the following personal data of you for the handling of the competition: Name, your stored e-mail address. The processing of the above data is necessary for the execution of the design competition and the handling of the prize. In the event that the data is not provided, participation in the design competition is not possible. The legal basis for the aforementioned processing of your personal data is Art. 6 para. 1 lit. b DS-GVO.
(c) If the respective legal requirements are met, you have the following data protection rights with regard to the personal data concerning you: the right of access, the right to receive a copy, the right of correction or deletion, the right of completion, the right to limit processing, the right to object to processing and the right to transfer data. You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.
(d) Your personal data will be processed by us for as long as this is necessary for the implementation and handling of the design competition. In the event of a win, the data may also be processed in accordance with commercial and tax law requirements (standard period of ten years).
7. Facebook terms and conditions
(b) Participants may not make any claims against Facebook in connection with the use of the Design Contest application or participation in the Design Contest.
(c) Neither a design contest application nor a design contest is in any way sponsored, endorsed, or organized by Facebook, nor is it affiliated with Facebook.
(d) All information and data provided to or collected by participants through the use of a design contest application or design contest will be provided only to J.Clay and not to Facebook.
(e) All requests and notices regarding the design contest should be directed to J.Clay and not Facebook.
8. Hinweise und Bedingungen von Mailchimp
(b) Participants cannot make any claims against Mailchimp in connection with the use of the application for the design contest or participation in the design contest.
(c) Neither an application for the design contest nor a design contest is in any way sponsored, supported or organized by Mailchimp or has any connection with Mailchimp.
(d) All information and data, which are given or collected by the participants through the use of an application for the design contest or a design contest, are only provided to J.Clay and not to Mailchimp.
(e) All requests and notices regarding the design contest should be directed to J.Clay and not to Mailchimp..
9. Final provisions
(a) Should any provision of the terms and conditions be or become invalid, this shall not affect the validity of the remaining contract.
(b) The law of the Federal Republic of Germany shall apply to the exclusion of the conflict of laws provisions.
